Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ChannelGen website, platform, and AI video generation services (collectively, the "Service") operated by ChannelGen ("ChannelGen", "us", "we", or "our"). Please read these Terms carefully before using our Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy (found at channelgen.com/privacy). If you disagree with any part of the terms, then you may not access the Service. Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms.

2. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Subscription Plans and Billing

ChannelGen offers multiple subscription tiers with varying features and video generation quotas:

• Free Plan: 1 free video included, then pay-per-video at $2.99 per video
• Starter Plan: $19/month for 5 videos
• Basic Plan: $29/month for 10 videos
• Creator Plan: $49/month for 20 videos
• Pro Plan: $149/month for 75 videos

All payments are processed securely through Cryptomus and accept cryptocurrency (USDT, BTC, ETH). Subscriptions automatically renew unless canceled before the renewal date. You are responsible for canceling your subscription if you no longer wish to use the Service.

4. Content Generation and Usage

ChannelGen provides two content generation modes:

• Custom Script Mode: You provide a script, and our AI optimizes it for 8-second video format
• Topic-Based Mode: You provide a topic, and our AI generates content after policy sanitization

You retain all rights to your input content (scripts, topics). For AI-generated content (videos, optimized scripts), you are granted a license to use the generated content for your purposes. ChannelGen retains the right to use anonymized usage data for improving our Services.

5. Content Policy and Prohibited Activities

As a user of the Service, you agree not to:

• Generate content that violates Google's content policies (our AI performs automatic sanitization checks)
• Create content containing child sexual abuse imagery (CSAI)
• Promote violent extremism, terrorism, or dangerous activities
• Generate hate speech, harassment, or content that bullies individuals or groups
• Create sexually explicit or graphic violent content
• Generate spam, deceptive practices, or malicious content
• Systematically retrieve data from the Service to create a competing service
• Use the Service to advertise or offer goods and services not authorized by us
• Circumvent or disable security features of the Service
• Engage in automated use of the system using scripts or bots
• Attempt to impersonate another user or person
• Use the Service for any revenue-generating endeavor that competes with us
• Reverse engineer any of the software comprising the Service
• Upload or transmit viruses, malware, or other harmful code

6. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of ChannelGen and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Video Quotas and Overages

Each subscription plan includes a monthly video generation quota. Once your quota is exhausted:

• You can purchase additional videos at per-video rates specific to your plan
• Unused videos do not roll over to the next month
• Quotas reset on your subscription renewal date

8. Watermarks

Free, Starter, and Basic plans include a ChannelGen watermark on generated videos. You can purchase watermark removal as an add-on for $15/month. Creator and Pro plans do not include watermarks. Pro plan includes white-label capabilities.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service, or contact us to request account deletion.

10. Limitation Of Liability

In no event shall ChannelGen, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use or alteration of your transmissions or content

11. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

ChannelGen does not warrant that:

• The Service will function uninterrupted, secure or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements
• AI-generated content will be free from errors or suitable for your specific purpose

12. API Usage

If you use our API, you agree to:

• Use API keys securely and not share them publicly
• Respect rate limits and usage quotas
• Attribute ChannelGen when required
• Not use the API to create a competing service

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
